Terms of Service

By creating an account or using DocsNote (the “Service”) you agree to these Terms of Service. If you do not agree, do not use the Service. These terms form a legally binding agreement between you and Agilecookies Ltd.

DocsNote is a product of Agilecookies Ltd, a company registered in England and Wales (“the Company”, “we”, “us”). The Service is provided as a software-as-a-service offering on a subscription basis.

DocsNote is not a medical device. The Service is a productivity tool that captures audio and transcribes it into text. It does not diagnose, treat, monitor or recommend any treatment, and it is not regulated under UK MDR 2002 or EU MDR 2017.

Transcription errors can and do occur. You must independently review and verify every transcript before relying on it for patient care.

All clinical judgements, diagnoses, prescribing decisions and treatment plans remain the sole responsibility of the treating clinician. The Company has no role in, and accepts no responsibility for, any clinical decision made by users of the Service.

• You must be a registered healthcare professional or operating under their direction.
• You must obtain any consent required from patients before recording a consultation.
• You are responsible for the accuracy and completeness of any note produced using the Service.

Paid plans are billed monthly or annually depending on the option you select at sign-up. Subscriptions auto-renew at the end of each billing period unless cancelled. Cancellations take effect at the end of the current billing period.

Pricing may change from time to time. We will provide at least 30 days' notice via email of any price change before it applies to your subscription. Taxes (VAT) are added at checkout where applicable.

All paid plans include a 14-day free trial. No credit card is required to start the trial. You may cancel at any time during the trial period without charge. If you do not cancel before the trial ends and you have provided payment details, your subscription will begin and you will be billed under the plan you selected.

You may not:

• Reverse engineer, decompile or otherwise attempt to extract the source code of the Service.
• Use the Service to violate any law or third-party right.
• Record any party without their knowledge where consent is required by law.
• Attempt to disrupt, overload or breach the security of the Service.

All rights in the DocsNote software, branding and underlying technology belong to Agilecookies Ltd and its licensors. You retain full ownership of any recordings, transcripts and clinical notes you produce using the Service — they are yours.

You grant us a limited licence to process the data you submit only to the extent necessary to provide the Service to you. We never use your content for training, advertising or any other purpose.

To the maximum extent permitted by law, Agilecookies Ltd shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or goodwill. Our aggregate liability under these terms shall not exceed the fees you paid in the twelve months preceding the claim.

Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with these terms.
